Terms and Conditions of Sale

Article 1 - Purpose and scope
These Terms and Conditions of Sale (the "Terms") govern exclusively the sale of ready-to-wear garments and accessories offered on the online shop available at store.euriellvairecreations.fr (the "Shop").
These Terms are separate from those applying to bespoke and custom-made orders placed through the website euriellvairecreations.fr. The items sold on the Shop are pre-made models, offered for sale as is or in defined sizes, and are not personalised to the customer's specifications.
Any order placed on the Shop implies the customer's full acceptance of these Terms, which the customer acknowledges before validating the order. The seller reserves the right to amend the Terms at any time; the applicable version is the one in force on the date of the order.

Article 3 - Products
The essential characteristics of the products (composition, sizes, colours, care instructions) are presented on each product page. Photographs and illustrations are as accurate as possible but cannot bind the seller as regards slight variations in colour or appearance due to the customer's screen display.
Product offers are valid while stocks last. If an item becomes unavailable after the order has been placed, the customer is informed as soon as possible and refunded the amount paid for the unavailable item.
Article 4 - Prices
Prices are shown in euros.
For orders delivered within the European Union, prices are shown inclusive of all taxes, applicable VAT included.
For orders delivered outside the European Union, prices are invoiced exclusive of tax. Any customs duties, import VAT and other applicable taxes are payable solely by the customer to the authorities of their country. It is the customer's responsibility to check with those authorities before ordering.
Delivery costs are stated separately before the order is finally validated. The total price payable, including costs, is displayed to the customer before final confirmation of the order.
Article 5 - Orders
The customer selects the items, reviews the contents of the basket, enters their delivery and billing details, then validates the order after having read these Terms.
Validation of the order, following a summary step allowing the customer to check and correct its contents, constitutes conclusion of the contract (the "double-click" process). A confirmation email summarising the order is sent to the customer.
The seller reserves the right to refuse or cancel any order on legitimate grounds, in particular in the event of a prior dispute, an abnormal order, or suspected fraud.
Article 6 - Payment
Payment is made at the time of ordering by the means offered on the Shop: Stripe or PayPal.
Payments are secured by Stripe or PayPal. The seller never has access to the customer's full bank card details.
The order is processed and shipped only after payment has actually been received.
Article 7 - Delivery
Delivery areas: international.
Carriers and indicative times:
- France and Belgium: Colissimo or Mondial Relay, estimated 6 working days.
- International: UPS, estimated 10 days.
- Express option available on request, at additional cost.
Delivery costs are stated before the order is validated.
Delivery times are given for guidance only. In the event of delay, the customer may, under the conditions provided by the French Consumer Code, request cancellation of the sale if delivery does not take place within a reasonable additional period.
Transfer of risk: in accordance with article L.216-4 of the French Consumer Code, the risk of loss or damage to the products passes to the customer when the customer, or a third party designated by the customer, takes physical possession of the goods. Where the customer entrusts delivery to a carrier of their own choosing (other than those offered by the seller), risk passes upon handover to that carrier.
Outside the European Union: customs duties and import taxes may apply on delivery; they are payable by the customer (see Article 4).
Article 8 - Right of withdrawal
In accordance with articles L.221-18 et seq. of the French Consumer Code, the consumer customer has a period of 14 days to exercise their right of withdrawal, without having to give reasons or bear any costs other than the return costs mentioned below.
Start of the period: the period runs from the day after the customer, or a third party designated by them (other than the carrier), receives the last item of the order. If the period ends on a Saturday, Sunday or public holiday, it is extended to the next working day.
How to withdraw:
- Using the online withdrawal function accessible from the customer account or order-tracking page, identified by the wording "Withdraw from my order", available free of charge throughout the withdrawal period (in accordance with article L.221-21 and decree D.221-5 of the French Consumer Code, applicable to contracts concluded from 19 June 2026);
- or using the model withdrawal form set out in the annex;
- or by any unambiguous statement sent to [email protected].
The seller acknowledges receipt of any withdrawal exercised online without delay, on a durable medium.
Returning the items: the customer returns the items without undue delay and at the latest 14 days after notifying their decision to withdraw. Return costs are borne by the customer. Items must be returned complete, in their original condition, unworn, unwashed, with their tags attached.
Diminished value: the customer may be held liable for any diminished value of the items resulting from handling other than what is necessary to establish their nature, characteristics and proper functioning (for example, a reasonable try-on, as in a shop).
Refund: the seller refunds all sums paid, including standard delivery costs, at the latest 14 days after being informed of the withdrawal. The seller may withhold the refund until the items have been recovered or until the customer provides proof of their dispatch, whichever is earlier. The refund is made using the same means of payment as that used for the order, unless the customer expressly agrees to another means. If the customer chose a delivery method more expensive than the standard offer, the additional cost is not refunded.
Exceptions: in accordance with article L.221-28 of the French Consumer Code, the right of withdrawal does not apply, in particular, to goods made to the consumer's specifications or clearly personalised (which fall under the bespoke website and not this Shop), nor to sealed goods which cannot be returned for hygiene reasons once unsealed.
Article 9 - Legal guarantees
Independently of any commercial guarantee, the seller remains bound by the legal guarantees set out below.
LEGAL GUARANTEES
Legal guarantee of conformity (articles L.217-3 et seq. of the French Consumer Code) The customer has 2 years from delivery of the goods to act. They may obtain repair or replacement of the non-conforming item and, failing that, a price reduction or cancellation of the sale, under the conditions provided by law. The customer is exempt from proving the existence of the lack of conformity during the 24 months following delivery. The legal guarantee of conformity applies at no cost to the customer. Where the item is repaired under this guarantee, it benefits from a 6-month extension of the guarantee; where it is replaced, a new 2-year period runs from delivery of the replacement.
Legal guarantee against hidden defects (articles 1641 et seq. of the French Civil Code) The customer may choose to invoke the guarantee against hidden defects in the item sold. They then have 2 years from discovery of the defect and may choose between cancellation of the sale or a price reduction, in accordance with article 1644 of the French Civil Code.
To assert these rights, the customer contacts the seller at [email protected] describing the defect, with supporting evidence (photos, videos).
Article 10 - Liability and force majeure
The seller cannot be held liable for non-performance or improper performance of the contract attributable to the customer, to the unforeseeable and insurmountable act of a third party, or to an event of force majeure. In any event, the seller's liability may not exceed the amount of the order, without prejudice to the legal guarantees referred to in Article 9.
Article 11 - Personal data
Data collected when processing orders is handled in accordance with the General Data Protection Regulation (GDPR) and the French Data Protection Act. It is necessary to process orders, provide customer service and comply with legal and accounting obligations.
The customer has a right of access, rectification, erasure, restriction, objection and portability of their data, which they may exercise at [email protected]. Full details are set out in the Shop's Privacy Policy.
Article 12 - Intellectual property
All elements of the Shop (creations, designs, photographs, texts, logo, Euriell Vairë Créations visual identity) are protected by intellectual property law and remain the exclusive property of the seller. Any reproduction or use without written authorisation is prohibited.
Article 13 - Complaints and consumer mediation
For any complaint, the customer first contacts the seller at [email protected], who will endeavour to find an amicable solution.
In accordance with articles L.612-1 et seq. of the French Consumer Code, the consumer customer has the right to use a consumer mediator free of charge, after having sent a written complaint to the seller and in the absence of a satisfactory reply within one month.

For cross-border disputes within the EU, the customer may contact the European Consumer Centres Network (the European Consumer Centre France for residents of France).
Article 14 - Governing law, foreign customers and jurisdiction
These Terms are governed by French law.
Customers residing in another European Union country: the choice of French law does not deprive the consumer of the protection afforded by the mandatory provisions of the law of their country of habitual residence, in accordance with article 6 of the Rome I Regulation (EU). The consumer also retains the option of bringing proceedings before the courts of their country of residence (Brussels I bis Regulation). The protection base is largely harmonised within the EU (14-day right of withdrawal, 2-year legal guarantee).
Customers residing outside the European Union: the contract is governed by French law; tax and customs obligations on importation fall under the law of the country of destination and are borne by the customer (see Articles 4 and 7).
In the event of a dispute, and failing an amicable solution or successful mediation, jurisdiction lies with the French courts under the conditions provided by law, without prejudice to the protective rules applicable to consumers.
